Crown did not betray iwi trust - court

A High Court judgement has found the Crown has not betrayed Taranaki Whanui iwi by offering land to neighbouring iwi, Ngati Toa.

The High Court has dismissed a case brought by the Port Nicholson Block Settlement Trust, which said the Crown double-crossed it.

The trust represents a Taranaki tribal collective. It argued in a two-day hearing that the Crown betrayed their 2009 settlement by offering Ngati Toa land that Taranaki Whanui has rights to - without consulting them.

Ngati Toa has initialled a $75 million dollar Waitangi Treaty settlement agreement that includes the chance to buy several properties in the Wellington area.

The High Court judgement released on Thursday says the Taranaki collective did not show exclusive land rights over the Port Nicholson block, which encompasses central Wellington.

It also says provisions of the Taranaki Whanui Settlement Act regarding cultural redress do not limit the Crown from providing cultural redress to other iwi.
