A senior officer remains suspended despite police deciding not to charge him over a sexual complaint following a four-month inquiry.
Detective Inspector Mark Gutry has been stood down from duties after a woman approached police in December 2013 and made a complaint of a sexual nature.
Counties Manukau District Commander John Tims said on Tuesday that detectives from Wellington were called in and found that there was insufficient evidence to lay any charges.
The case was reviewed by the Wellington Crown Solicitor.
Mr Tims said a code of conduct investigation has begun but declined to comment further, as the matter is now an employment issue.
Mr Gutry's lawyer, Todd Simmonds, said the decision not to lay charges is a clear indication that the allegations had no substance, and his client is now looking forward to returning to work as soon as possible.
